IN ALL CASES, PIZZA LUCE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
The limitations of liability set forth above reflect a fair allocation of risk between the parties and form an essential basis of the bargain between you and Pizza Luce. These limitations shall apply notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted by applicable law.
8. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce and its owners, officers, directors, employees, agents, contractors, licensors, affiliates, successors, and assigns (collectively, "Indemnified Parties") from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way related to:

9. Governing Law and Jurisdiction

10. Dispute Resolution
10.1 Informal Resolution
In the event of any dispute, claim, or controversy between you and Pizza Luce arising out of or relating to these Terms or your use of our services ("Dispute"), both parties agree to first attempt to resolve the Dispute informally by contacting Pizza Luce at [email protected] and providing a written description of the Dispute, your proposed resolution, and your contact information. 10.2 Binding Arbitration

THE PARTIES UNDERSTAND THAT BY AGREEING TO ARBITRATION, THEY ARE WAIVING THEIR RIGHT TO HAVE THE DISPUTE DECIDED BY A JUDGE OR JURY IN A COURT OF LAW.
The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could award, including injunctive or other equitable relief. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The costs of arbitration shall be allocated in accordance with the applicable arbitration rules, subject to any applicable law.
10.3 Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PIZZA LUCE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, REPRESENTATIVE, OR COLLECTIVE ACTION OR PROCEEDING. No arbitrator or court may consolidate or join more than one person's or entity's claims against Pizza Luce, or otherwise preside over any form of a class or representative proceeding.
10.4 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies under applicable small claims court rules and procedures, and the claim remains in small claims court and is not removed to any other court.
11. Term and Termination
These Terms of Service are effective from the moment you first access or use our Website or services and continue in full force and effect until terminated as provided herein.
11.1 Termination by You

11.2 Termination by Pizza Luce

In the event of a Force Majeure Event, Pizza Luce will provide notice to affected customers as soon as reasonably practicable and will use commercially reasonable efforts to resume normal service operations as quickly as possible. During a Force Majeure Event, affected orders may be cancelled and refunded at Pizza Luce's discretion.
